Please read these terms and conditions carefully before you submit your order to Strepelle. These terms tell you who owns Strepelle, how we will provide products to you, how you and Luas Diagnostics Ltd may change or end the Contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms and conditions, please contact Luas Diagnostics Ltd to discuss.

Information about Strepelle 
Strepelle is a product owned by Luas Diagnostics Ltd, a limited private company incorporated in England and Wales with company number 12650546. Registered office: First Floor, 1 Chancery Lane, London WC2A 1LF.

The Strepelle Group B Strep test which consists of a home laboratory test kit for Group B Streptococcus (“GBS”) and the analysis of the samples provided by you to us (‘Strepelle Test’) and www.strepelle.com are owned and operated by Luas Diagnostics Ltd. Luas Diagnostics Ltd terms and conditions apply to all transactions on this site and you must read each section carefully. They do not affect your statutory rights or remedies as a consumer.

If Luas Diagnostics Ltd has to contact you, we will do so by telephone or by writing to you at the email address or postal address you provided to Luas Diagnostics Ltd in your order. “Writing” includes emails. When we use the words “writing” or “written” in these terms and conditions, this includes emails.

These terms and conditions (‘Terms’) govern the use of www.strepelle.com and the provision to you of the Strepelle Test consisting of the test kit and the analysis of the samples by us. Luas Diagnostics Ltd’s obligations with respect to its products and services are governed solely by these Terms. By using the website and/or placing an order you agree to be bound by these Terms. If you do not agree to these Terms you may not use or access www.strepelle.com or order any of our products or services.

These Terms and all transactions relating to this website are governed by English law and any disputes will be decided solely by the courts of England and Wales.

Contract
Luas Diagnostics Ltd’s acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and Luas Diagnostics Ltd (‘Contract’).

Availability
The products featured on the strepelle.com website are only available within the United Kingdom. Unfortunately, we do not accept orders from addresses outside the UK.

If we are unable to accept your order, we will inform you of this and will not charge you for the product. This might be because the product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified.

Prices and Conditions of Sale
Goods will be paid at the prices valid on the date of the confirmation of the Buyers order by the Seller (prices include VAT).

Test prices are as listed by Luas Diagnostics Ltd and/or the retailer and may be amended from time to time. Payment must be made in full prior to the test being undertaken.

Order Cancellation and Refund with Retailers
If you require a refund for any valid unused Strepelle Tests, incomplete or damaged boxes purchased from retailers or failed tests, this should be taken up directly with the retailer, subject to the retailer’s own return policies. Till receipts must be retained as proof of purchase.

Collection of Samples and Shipping
The Strepelle Test pack includes detailed instructions for use (‘User Instructions’) and the order form (‘Test Order Form’). You must read the User Instructions carefully prior to using the product. Information and instructions described in the User Instructions must be strictly followed. Non-compliance with the User Instructions can invalidate the Strepelle Test and affect the results of the Strepelle Test. You must complete the Test Order Form and ensure that it is enclosed with the sample submitted for testing. Luas Diagnostics Ltd is unable to test any sample submitted without a completed Test Order Form accompanying it.

A new Strepelle Test will have to be purchased if the Test Order Form is lost or not submitted with the sample.

Samples once collected in accordance with the User Instructions should be returned to us as soon as possible after collection, and no later than on the day on which you collect them. Every reasonable effort will be made to analyse your sample and issue a report on the results. If you have not followed the User Instructions or correctly completed the Test Order Form, we may be unable to process your sample. After your test sample has been processed we will forward you the results by email or in writing based on the preference indicated by you on the Test Order Form. We will use our reasonable endeavours to deliver your test results to you within 7 working days of Luas Diagnostics Ltd receiving your sample.

Return of Defective Goods
Any defects or damage to the test kit must be reported within 90 working days of receipt of goods by the customer. When you contact customer service we will give you instructions on returning the products. You will be required to quote your unique reference number quoted on this Test Order Form. Please contact Strepelle customer service at customerservice@strepelle.com

All recommended instructions of storage, use, collection and shipping provided by Luas Diagnostics Ltd in the User Instructions must be followed by you. If damage to the test equipment has been caused by misuse, abuse and/or neglect by you, your statutory rights and any warranties will be invalidated.

Delivery charges
In addition to the price of the test an order placed at our website also includes a postage and packaging charge which is separate from the price of the product displayed on the strepelle.com website. Every reasonable effort shall be made to keep to any delivery date, but time of delivery shall not be binding and Luas Diagnostics Ltd shall not be liable for any losses, costs, damages or expenses incurred by the customer or any other person or company arising directly or indirectly from any failure to meet any estimated delivery date provided that Luas Diagnostics Ltd shall deliver each Strepelle Test kit within 30 days after the day on which we accept your order. The risk in the goods shall pass from Luas Diagnostics Ltd to the customer upon delivery to the customer.

Your right to cancel the contract without giving any reason
You have the right to cancel this Contract within 14 days without giving any reason.

The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquired, physical possession of the goods.

Your right to cancel without giving any reason will end immediately once you open either of the identical swab packets (i.e. if any of the integrity seals have been removed).

To exercise the right to cancel, you must inform us using our contact details above under “Contacting Luas Diagnostics Ltd” of your decision to cancel this Contract by a clear statement (e.g. a letter sent by e-mail).

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

If you cancel this Contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).

We will make the reimbursement without undue delay, and not later than-
a) 14 days after the day we receive back from you any goods supplied, or
b) (if earlier) 14 days after the day you provide evidence that you have returned the goods, or
c) if there were no goods yet delivered, 14 days after the day on which we are informed about your decision to cancel this contract.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods to the address supplied to you by Strepelle Customer Service in the course of the returns process without undue delay and in any event not later than 14 days from the day on which your communication of cancellation from this Contract has been acknowledged by us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct costs of returning the goods.

Sample Requirements
The User Instructions leaflet included with the Strepelle Test kit outlines what you need to do to send a sample for analysis. It is recommended that you send back a sample on the same day of taking it. The sample must be yours.

A usable sample is one that has been collected by strictly following the instructions provided by Luas Diagnostics Ltd on the User Instructions for both rectal and vaginal swabs (‘Usable Sample’). It is essential that Luas Diagnostics Ltd receives a Usable Sample from you in order to proceed with analysing your sample. Luas Diagnostics Ltd will not be able to process your sample in the event that:
a) you fail to return a Usable Sample to us.
b) a problem with the sample provided by you renders Luas Diagnostics Ltd unable to proceed with analysing your sample; and/or
c) we are unable to extract usable information from the sample that you have provided.

Purpose and Limitations of the Strepelle Test
The Strepelle Test results are not intended to replace medical advice; they are intended to be used at the beginning of the care pathway as a convenient way of getting tested quickly for a suspected condition or to help with you and your family’s, health and wellbeing programme. The results contained should be used as screening results only and should not be used as a diagnosis or treatment for any health problem or disease, or for prescribing medication, without consulting your doctor or appropriate medical professional.

You must consult with your licenced medical practitioner before making any medical decisions. If you suspect you have a medical problem, you should consult your healthcare provider in the first instance. You must consult with your licenced medical practitioner prior to making any changes to your treatment or medication.

You will receive a copy of your results with a written statement about what they mean, together with any suggested action that you take.

Your pharmacist can also give you advice on the Strepelle Test, your results, your care pathway and where to go for further information.

We recommend that you follow the advice given with the results.

Luas Diagnostics Ltd makes every effort to ensure the accuracy of your results and will provide its analysis of your samples with reasonable care and skill. In any laboratory test, there will always be a small amount of variability, and our methods and reporting criteria are designed to account for this variation. The Strepelle Test result will naturally vary from day to day, and any further testing may give a result in the same range but that is not necessarily identical. Due to the nature of laboratory testing, Luas Diagnostics Ltd cannot guarantee the 100% accuracy of all test results.

It is the express responsibility of yourself to inspect your results immediately upon delivery. You shall notify Luas Diagnostics Ltd Customer Service by email at  customerservice@strepelle.com within 10 days of delivery in respect of any shortfall or incorrect test being carried out.

Miscellaneous
You acknowledge that all intellectual property rights/trademarks relating to the products are solely and exclusively owned by Luas Diagnostics Ltd.

You acknowledge that all intellectual property rights/trademarks relating to the products are solely and exclusively owned by Luas Diagnostics Ltd.

Entire Contract
The offer to sell products and provide services is expressly limited to the terms of the Contract and any information that Luas Diagnostics Ltd provides to you before the Contract is made and which you rely upon when deciding to enter the Contract. Any additional terms or conditions provided by you are rejected by Luas Diagnostics Ltd. If you submit an order you are deemed to have accepted these Terms to the exclusion of any other terms and conditions and any previous course of dealing. The Contract cannot be amended or modified unless agreed upon in writing by Luas Diagnostics Ltd.

Luas Diagnostics Ltd reserves the right to change these terms at any time, any changes made will not apply to the Contract for any order received before the changes are made.

Liability
Nothing in this clause shall exclude or limit liability for (i) death or personal injury caused by our negligence, or the negligence of our employees or agents; (ii) fraud or fraudulent misrepresentation; (iii) breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982; (iv) breach of the terms implied by section 12 of the Sale of Goods Act 1979; or (v) defective products under the Consumer Protection Act 1987. If we fail to comply with these terms and conditions, we shall not be responsible for any losses that you suffer as a result, except for those losses which are a foreseeable consequence of the failure to comply with these terms and conditions at the time we entered into this contract with one another. We only supply goods and services to you for domestic and private use. You agree not to use the goods for any commercial, business or re-sale purpose and we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity or other financial loss.

We do not accept any responsibility for any amendments or changes we may make to the information contained in our website and we reserve the right to alter these terms and conditions or the information contained on the website at any time. Any changes to these terms and conditions shall be highlighted and all purchases made from the date of the amendments, shall be subject to the replacement terms and conditions.

You shall be responsible for reading and understanding these Terms. We shall not be liable to any person for any loss or damage whatsoever which may arise from the use of any information contained in any of the materials on the website..

Use of Personal Information
When you submit your samples and Test Order Form, Luas Diagnostics Ltd will collect and process the personal and sensitive personal information you provide, as a data controller for the purposes of the General Data Protection Regulation (GDPR)2018. This personal information will be processed by Luas Diagnostics Ltd for the purposes of testing your samples and providing the test results to you. Your personal information may also be anonymised, with the anonymous information then used for research and/or statistical analysis (which will not identify you). Luas Diagnostics Ltd may appoint third parties within the UK to process your personal data (including your sensitive personal data) on its behalf for these purposes.

By providing your consent on your Test Order Form, you are providing your consent to the processing of your personal data and sensitive personal data by Luas Diagnostics Ltd for the above purposes.

Marketing
Your personal information may also be used to inform you by mail and/or e-mail of website changes, or new products and services offered by Luas Diagnostics Ltd. If you would prefer not to receive such communications, please contact customerservice@strepelle.com

The Strepelle website may contain links to other websites. If you use these links and leave our site, please be advised that we do not have any control over third party websites. As such we cannot be responsible for the protection and privacy of any information once you leave the Strepelle website. We would advise you to view the privacy statement applicable to any third-party websites. Personal Information we hold about you, you have the right to request a copy of any information that we currently hold about you.
